By accessing or using our website platform or software platform, you agree to be bound by these Terms of Use. If you do not agree, please do not use our website or software platform.

Products and Services
USA Environmental Services offers a range of products and services that focus on circularity, including technology solutions for managing waste collection and recycling, sustainability reporting, recycling education, and more. All products and services are subject to availability and may be subject to change without notice.

Access and Use of the Software Platform
Customers enrolled in the Smart Waste Program are granted access to our proprietary software platform ("Software Platform") for the duration of their participation. This platform utilizes waste and recycling data provided by and collected from the customer ("Waste and Recycling Data") to enhance service delivery. Use of the Software Platform is subject to these Terms of Use and any additional terms disclosed in the customer’s Service Agreement.

License Grant
Subject to compliance with the Master Service Agreement and these Terms, USA Environmental Services grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to:

• Access and use the Software Platform solely in connection with the services provided under the Smart Waste Program; and

• Access any content, information, and related materials made available through the Software Platform.

 

Ownership and Intellectual Property
The Software Platform, including all content, graphics, logos, articles, software, and any associated intellectual property, is owned by USA Environmental Services or its licensors and protected by applicable copyright and other laws. You receive only the rights expressly granted in your agreement with us.

All content on our website platform, including text, graphics, logos, images, and software, remains the property of Dumpster Connect, LLC or its affiliates and may not be copied, reproduced, modified, or distributed without our prior written permission.

License to Use Waste and Recycling Data
To the extent that you retain any rights in or to the Waste and Recycling Data, you unconditionally grant USA Environmental Services a worldwide, perpetual, irrevocable, royalty-free, fully paid, exclusive, sublicensable, and transferable right and license to use, commercially exploit, publish, reproduce, adapt, create derivative works, publicly display, publicly perform, and otherwise use such data.

Restrictions on Use
You may not:

• Remove any copyright, trademark, or other proprietary notices from any part of the Software Platform;

• Reproduce, modify, prepare derivative works from, distribute, license, sell, resell, publicly display, publicly perform, stream, or otherwise exploit the Software Platform, except as expressly permitted;

• Reverse engineer, decompile, or disassemble any part of the Software Platform, except where permitted by law;

• Link to, frame, or mirror any part of the Software Platform without express written permission;

• Use data scraping, bots, or scripts to access, monitor, or interfere with the Software Platform;

• Attempt to gain unauthorized access to the Software Platform, accounts, or systems you do not have permission to access.

 

Payment
Payment for products and services purchased through our website platform must be made using a valid credit or debit card. All payments are processed through a secure payment gateway, and we do not store any credit or debit card details on our servers.

Shipping
Shipping of physical products will be arranged by USA Environmental Services, and the cost of shipping will be calculated at checkout. Estimated delivery times will be communicated at the time of purchase.

Returns and Refunds
Products may be returned for a refund within 30 days of purchase. To initiate a return, please contact our customer service team. Returns and refunds are not available for services. However, we will make reasonable efforts to resolve service concerns—contact us at support@usaenv.com.

Limitation of Liability
To the extent permitted by law, USA Environmental Services will not be liable for any direct, indirect, incidental, special, or consequential damages related to your use of our website or software platform, including but not limited to loss of revenue, profits, or data.

Indemnification
You agree to indemnify and hold Dumpster Connect, LLC and its affiliates, officers, directors, employees, and agents harmless from any claims arising out of your use of the website or Software Platform, or your violation of these Terms.

Governing Law
These Terms of Use shall be governed by the laws of the State of California. All disputes must be brought exclusively in the state or federal courts located in San Diego County, California.

We may update these Terms of Use at any time. Continued use of our website or Software Platform after changes indicates acceptance of the new Terms.
